India Reach (Chemical Management & Safety Rules) – Complete Guide

Introduction

India Reach, officially referred to as the Chemical (Management & Safety) Rules (CMS Rules), is India’s upcoming national chemical regulation framework. These rules aim to establish a comprehensive system for the management, safety, registration, and control of chemicals manufactured, imported, or used in India.

The Government of India has circulated the Draft Chemical (Management and Safety) Rules, commonly known as India REACH / ICMS Rules / CMS Rules, which will replace the existing:

  • Manufacture, Storage & Import of Hazardous Chemicals (MSIHC) Rules, 1989
  • Chemical Accidents (Emergency Planning, Preparedness & Response) Rules, 1996

The CMS Rules are notified under Sections 3, 6, and 25 of the Environment (Protection) Act, 1986 and are designed on principles similar to EU REACH, with a strong focus on chemical safety, traceability, and environmental protection.

Expected implementation: Phased implementation following notification by the Government of India.

Applicability of India Reach Compliance

Once notified, India REACH will be applicable to:

  • Indian Manufacturers
  • Indian Importers
  • Authorized Indian Representatives (AIR) appointed by foreign manufacturers
  • Foreign Manufacturers, through an Authorized Indian Representative

Foreign manufacturers cannot directly register under India REACH and must appoint an Authorized Indian Representative (AIR) to fulfill all regulatory obligations.

Basic Compliance Requirements under INDIA REACH

A. Notification & Annual Reporting

Notification

  • Mandatory for all existing and new substances, including priority and hazardous substances
  • Applicable when quantity exceeds 1 tonne per annum
  • Requires:
    • Substance identity details
    • Safety Data Sheet (SDS)
    • Hazard classification and use information
  • Upon successful submission, a Notification Number and Certificate are issued.

Annual Reporting

  • Mandatory update of all notified substances
  • Must include:
    • Actual quantities placed on the Indian market in the previous calendar year
    • Any changes to previously submitted information
  • Timeline: Within 60 days of the end of the calendar year
  • Authority fee applies
B. Registration of Substances

Registration is mandatory for priority substances listed in Schedule II when used above 1 tonne per year.

  • Currently covered: ~750 substances (list to expand)
  • Registration timeline: 1.5 years from the date of inclusion in Schedule II
  • Registration Dossier Requirements

  • Technical Dossier (as per Schedule VII)
  • Chemical Safety Report (CSR)
  • Exposure Scenario (ES)
  • Test reports from NABL-accredited or GLP-certified laboratories

Existing test data should be used wherever possible to avoid duplicate testing.

Joint Registration

Multiple entities dealing with the same substance may opt for joint registration, provided all individual obligations under the Rules are met.

Transported Intermediate Registration

  • Applies to intermediates listed in Schedule II
  • Below 1000 TPA: Physical & chemical properties only
  • Above 1000 TPA: Technical dossier + CSR
  • Timeline: 1.5 years from Schedule II inclusion

A Registration Number and Certificate are issued upon approval. Authority fees are tonnage-based, with fee concessions for MSMEs.

C. Priority Substances

Priority substances include:

  • CMR substances (Category 1 or 2)
  • STOT Category 1 or 2
  • PBT / vPvB substances
  • Substances listed in Schedule II
  • Compliance Obligations

  • Chemical Safety Assessment
  • Exposure Scenario (up to 10 TPA)
  • Full Chemical Safety Report (above 10 TPA)

CSR requirements follow Schedule VIII, aligned with GHS Rev. 8.

Import Control of Priority & Hazardous Chemicals

After completing Notification and Registration, importers must submit prior import information at least 15 days before import, including:

  • Consignee details in India
  • Port of entry
  • Mode of transport
  • Substance identity and quantity
  • Safety Data Sheet (SDS)

Imports may be restricted or stopped if authorities identify unacceptable safety or environmental risks.

Labeling & Packaging Requirements

  • Mandatory for:
    • Priority substances
    • Hazardous chemicals
    • Mixtures containing >10% w/w of such substances
  • Labels must comply with Schedule XVII
  • Label language: English & Hindi
  • Packaging must meet prescribed safety standards

Safety Data Sheet (SDS) Obligations

  • Mandatory SDS for:
    • All notified substances
    • Hazardous chemicals
    • Articles containing >1% w/w of Schedule II substances
  • SDS must be prepared as per Schedule IX (GHS Rev. 8)
  • SDS must be kept updated and submitted to authorities when required
Evaluation, Restriction & Authorization

All registered substances are subject to risk-based evaluation, including:

  • Hazard identification
  • Exposure assessment
  • Risk characterization

If a substance poses unacceptable risk, authorities may:

  • Restrict its use
  • Prohibit the substance
  • Amend Schedules X, XI, or XII

Authorization

  • Required for continued use of restricted substances
  • Valid for 4 years, extendable once
  • Authority fee applies

Hazardous Chemicals Management

These provisions govern:

  • Manufacture
  • Storage
  • Handling

  • Emergency preparedness & accident management

Transport of Hazardous Chemicals

When transporting hazardous chemicals:

  • Prior intimation to State Pollution Control Boards (SPCBs) is mandatory for inter-state movement
